Terms of Service

1. Acceptance of Terms

By accessing or using Visina AI (www.visina.ai), you agree to be bound by these Terms of Service. If you do not agree, do not use the service. These terms apply to all users of the platform. You must be at least 18 years old to use Visina AI. By using the service, you represent and warrant that you are at least 18 years of age.

2. The Service

Visina AI provides an AI-powered creative studio for generating images and videos using text prompts and reference images. The service is provided on a credit-based system — you purchase one-time credit packs to generate content.

Visina AI integrates with third-party AI models to power its generation capabilities. Visina AI is an independent service and is not affiliated with, endorsed by, or sponsored by any AI model provider, including but not limited to Google, OpenAI, ByteDance, Black Forest Labs, xAI, or Alibaba.

3. Credits & Payments

• Credits are purchased as one-time packs and are non-refundable once used for generation.
• Credits are valid for 30 days from the date of purchase. Every new purchase or top-up extends your entire unused balance for a further 30 days from the date of that purchase, so active users do not lose credits.
• Credits remaining after the 30-day window has elapsed without a further purchase are forfeited.
• Payments are processed by our payment partners, including Stripe and PayU. We do not store your card or payment details.
• Prices are listed in USD and may be subject to local taxes depending on your jurisdiction.
• We reserve the right to change pricing at any time. Existing purchased credits are unaffected.

4. Refund Policy

You may request a refund within 3 days of your initial credit pack purchase, subject to the following conditions:

• Refunds are only available if no credits have been used from the purchased pack. Once you use even a single credit for any generation, you are no longer eligible for a refund.
• Refunds apply only to your first purchase on Visina AI. Subsequent credit pack purchases, top-ups, or additional packs are final and non-refundable.
• A service fee of up to 6% of the purchase amount may be deducted from the refund where legally permitted, to cover payment processing costs.
• Refund requests must be submitted within 3 days of the original purchase date by emailing support@visina.ai with your order details.
• Approved refunds are processed within 5–7 business days to the original payment method.

If a generation fails due to a technical error on our end, the credits consumed by that generation are automatically restored to your account balance. This is an internal credit restoration, not a monetary refund.

We will respond to all refund and support requests within 3 business days of receipt. Full details are set out in our Cancellation & Refund Policy.

5. Acceptable Use Policy (AUP) & Prohibited Content

You agree not to use Visina AI to generate, upload, or distribute any of the following prohibited content:

• NSFW & Sexually Explicit Content: Sexually explicit material, pornography, nudity, sexually suggestive or provocative content, non-consensual sexual content (NCSC), or any borderline NSFW material. This prohibition applies to all generated content, including content used in galleries, showcases, portfolios, or marketing materials.
• Child Sexual Abuse Material (CSAM): Any depiction of minors in a sexual, exploitative, or harmful manner. Any generation of CSAM will be immediately reported to the National Center for Missing & Exploited Children (NCMEC) and appropriate law enforcement agencies.
• Deepfakes, Face-Swap & Face Manipulation: Face-swap, deepfake, and face-manipulation content of any kind. This includes non-consensual deepfakes of real people, impersonation, identity theft, or content intended to defame, deceive, or manipulate (including political misinformation involving public figures). The use of Visina AI as a face-swap, face-manipulation, or deepfake tool is strictly prohibited regardless of intent.
• Violence & Gore: Gratuitous violence, extreme gore, mutilation, or content promoting self-harm, suicide, or providing instructions on creating weapons or explosives.
• Hate Speech & Harassment: Content that promotes discrimination, hatred, or violence against individuals or groups based on race, religion, gender, sexual orientation, or disability. Harassment, bullying, or threatening material is strictly prohibited.
• Fraud & Illegal Acts: Phishing materials, malware, scams, or any content that violates local, state, national, or international laws.
• Intellectual Property & Copyright Infringement: Content that infringes on third-party intellectual property rights, trademarks, or copyrights. You represent and warrant that you have all necessary rights to any reference images or materials you upload.
• Circumvention of Safety Systems: Attempting to bypass, disable, circumvent, or reverse-engineer content moderation filters, safety systems, or any automated safeguards is prohibited.

6. Content Moderation

All prompts and generated outputs are subject to automated content moderation. We employ both first-party and third-party moderation systems to detect and block prohibited content before and after generation.

We reserve the right to proactively monitor and review generated content for safety and compliance purposes. Generated content that violates our Acceptable Use Policy may be automatically blocked, removed, or flagged for manual review.

Visina AI is not marketed as, and does not offer, "uncensored", "unfiltered", "NSFW", "18+", or "no filter" generation capabilities. Any such claims made by third parties are false and unauthorized.

7. AI Model Disclaimer

Visina AI is an independent service and is not affiliated with, endorsed by, or sponsored by Google, OpenAI, ByteDance, Black Forest Labs, xAI, Alibaba, or any other AI model provider. References to model names on this platform are for informational purposes only and do not imply any partnership or endorsement.

8. Intellectual Property

You retain ownership of the content you generate using Visina AI, subject to the terms of the underlying AI model providers. By using the service, you grant us a limited licence to process your prompts and inputs solely to provide the service. We do not claim ownership of your generated content.

9. Account Termination & Zero Tolerance Policy

We employ a zero-tolerance policy for violations of our Acceptable Use Policy.

• We reserve the right to proactively monitor and review generated content for safety and compliance purposes.
• We reserve the right to immediately suspend, block, or terminate your account at any time if you violate these Terms of Service (especially the Acceptable Use Policy), engage in fraudulent activity, or abuse the platform.
• Account termination due to AUP violations will result in the immediate forfeiture of all unused credits without notice and without eligibility for a refund.

You may close your account voluntarily at any time by contacting support@visina.ai.

10. Disclaimer of Warranties

Visina AI is provided "as is" without warranties of any kind. We do not guarantee that the service will be uninterrupted, error-free, or that generated content will meet your expectations. AI-generated content may be unpredictable in quality or accuracy.

11. Limitation of Liability

To the fullest extent permitted by law, Visina AI shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability to you shall not exceed the amount you paid us in the 30 days preceding the claim.

12. Governing Law

These Terms of Service are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of India.

13. Changes to Terms

We may update these Terms of Service at any time. Continued use of the service after changes are posted constitutes acceptance of the new terms. We will notify users of significant changes via email where possible.
